NIL Privacy Policy
This Privacy Policy informs you about how we process your personal information if you contact us by other means than using our contact form on the website learning.nil.com or if you appear as a contact person in a contractual relationship between the organization you represent and us.
This Privacy Policy does not include information on how we process your personal data if, for example, you sign up for our newsletter, are an employee or job applicant, use a Contact Us form on the website, and so on. For any such processing of personal data, you will be informed separately in connection with your sign-up or use of the service that causes the processing of your personal data. In Part II below, you may find a reference to the relevant information for such services.
Our processing of personal data in connection with the NIL website’s use of cookies is regulated in our cookie policy. You can access the cookie policy through Part II below.

Purposes and Legal Basis for the Processing of Personal Data
We process your personal information to handle and process your inquiry or complete the customer relationship in relation to which your information is registered.
The processing of your personal data is based on GDPR Article 6 (1) (f). The legitimate interests we pursue are the handling of your inquiry, follow-up, and general customer service.
If you appear as a contact person in a contractual relationship between your employer and us, the processing of your personal data is based on GDPR Article 6 (1) (b). We process your personal data for the performance of the applicable contract.
Recipients or Categories of Recipients of Your Personal Information
In order to process your inquiry, it may be necessary to pass on your information to a company associated with Conscia Group, that is, members of Conscia Group (see table with local legal entities above).
If it is relevant to the processing of your inquiry or for the performance of a contract between your employer and us, we can also pass on your information to partners, that is, authorized dealers as well as subcontractors.
Retention Period
We only store your information for as long as it is relevant, or if there are specific legal reasons, and/or a legal requirement that stipulates a longer storage period like. The criteria used to determine our retention periods include:
- Whether there are statutory retention requirements (for example, accounting or financial requirements).
- The length of time we have an ongoing relationship with you and provide services to you (for example, for as long as you keep using our services) and the length of time thereafter during which we may have a legitimate need to reference your personal information to address issues that may arise.
- The data are still required to assert and exercise legal claims or to defend against legal claims.
- Requirements to defend against cybersecurity incidents.
- Another exception according to Art. 17 Para. 3 GDPR.

Privacy Notice for California Residents
Introduction
This Privacy Notice for California Residents applies solely to visitors, users, and others who reside in the State of California (“consumers” or “you”) and supplements the information contained in the rest of our privacy policy and privacy terms.
What Information We Collect and How

We do not sell your personal information. We may however share your personal information with the following categories of third parties:
- Service providers: We engage third-party service providers to perform business purposes on our behalf, such as data analysis, email delivery, hosting services and marketing assistance.
- Affiliates: We may share your information with our affiliates for business purposes consistent with this privacy policy and the cookie policy.

Your Rights and Choices
The California Consumer Privacy Act (“CCPA”) provides California residents with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.
- Access
- You may have the right to request that we disclose certain information to you about our collection and use of your personal information, including a copy of the personal information we have collected. You have the right to know what personal information we collected about you, including the categories of information, the categories of sources from which the information is collected, the business purpose for use or sharing of the information, the categories of third parties to whom we disclosed information, and the specific pieces of information we have collected about you.
- Deletion
- You also may have the right to request that we delete personal information that we collected from you, subject to certain exceptions. Once we receive and verify your request, we will delete your personal information from our systems, unless an exception applies. If applicable, we will also notify third parties, service providers and contractors with whom we may have shared your data of your request for deletion.
- Correction
- You may have the right to request that we correct inaccurate personal information, considering the nature of the personal information and the purposes of maintaining your personal information. Upon verifying the validity of a verifiable consumer correction request, we will use commercially reasonable efforts to correct your personal information as requested. We may reject a request for correction if we are unable to verify your identity or if we determine that the contested personal information is more likely than not accurate based on the totality of the circumstances. If necessary, we may request that you provide documentation that the personal information is inaccurate.
- Opt out of the sale or sharing of personal data
- We do not sell personal information to third parties. We share personal information with third parties for the business purposes described in the privacy (including individual terms from Part II) and the cookie policy, including, without limitation, advertising, and marketing. You may opt out of such processing by not consenting to marketing cookies. You can always change this setting by clicking on the cookie icon in the bottom left-hand corner of our websites.

Retention periods are determined in in the Part I of the Privacy policy, in the special terms listed in Part II and in the Cookie policy.
Changes to Our Privacy Notice
We reserve the right to amend this privacy notice at our discretion and at any time. When we make changes to this privacy notice, we will post the updated notice on our website and update the notice’s effective date. Your continued use of our website following the posting of changes constitutes your acceptance of such changes.
